Terms and Conditions/Returns/Delivery

These Terms and Conditions will apply to the purchase of the goods by you (the Customer). We are ‘Carlsberg Britvic Group’ which for these purposes comprises Carlsberg Marston’s Brewing Company Limited (reg. no. 00078439), CMBC Supply Limited (reg. no. 08626420) and Carlsberg Marston’s Limited (reg. no. 12577732) each of Marston’s House, Brewery Road, Wolverhampton, England, WV1 4JT and Britvic plc (05604923) and Britvic Soft Drinks Limited (00517211) each of Breakspear Park, Breakspear Way, Hemel Hempstead, Hertfordshire HP2 4TZ and each limited companies registered in England and Wales (the member of the Carlsberg Britvic Group that sends you this email is referred to as ‘we’, ‘us’, or ‘our’). with email address breweryshopburton@carlsbergmarstons.co.uk; (the Supplier or us or we).

These are the terms on which we sell all Goods to you. By ordering any of the Goods, you agree to be bound by these Terms and Conditions. You can only purchase the Goods from the Website if you are eligible to enter into a contract and are at least 18 years old.

Goods

• The description of the Goods is as set out in the Website, catalogues, brochures or other form of advertisement.  All Goods which appear on the Website are subject to availability.

Basis of Sale

• The Order process is set out on the Website. Each step allows you to check and amend any errors before submitting the Order. It is your responsibility to check that you have used the ordering process correctly.
• When an Order has been submitted on the Website, we can reject it for any reason, although we will try to tell you the reason without delay.
• A Contract will be formed for the sale of Goods ordered only when you receive an email from us confirming the Order (Order Confirmation). You must ensure that the Order Confirmation is complete and accurate and inform us immediately of any errors. We are not responsible for any inaccuracies in the Order placed by you. By placing an Order you agree to us giving you confirmation of the Contract by means of an email with all information in it (i.e. the Order Confirmation).

Food Past The Best Before Date

• ‘Carlsberg Britvic Group’ will sometimes sell food that is close to or past it’s Best Before Date. If an item is past its best before date the date will be clearly mentioned in the item title, and item description.
• It is the customer’s responsibility to check any date before purchasing. If you are unsure of the Best Before Date or require any further information before purchasing please email breweryshopburton@carlsbergmarstons.co.uk;
• ‘Carlsberg Britvic Group’ reserves the right to refuse a refund on an item that passed the Best Before Date, where this has been correctly advertised. Please note that products past its Best Before Date, are non-returnable and non-refundable.

Price And Payment

• The price of the Goods and any additional delivery or other charges is that set out on the Website at the date of the Order or such other price, as we may agree in writing. Prices and charges include VAT at the rate applicable at the time of the Order.
• You must pay by submitting your credit or debit card details with your Order and we can take payment immediately or otherwise before delivery of the Goods.

Delivery

• Before you finalise your order, you’ll be given various delivery options to choose from. Orders are shipped to your delivery address from ‘Carlsberg Britvic Group’ Shobnall Road, Burton on Trent, DE14 2BG
• All orders will be dispatched within 10 working days of the order being placed.
• Should delivery be attempted but there is no answer, the courier will; leave a missed delivery card for rescheduling delivery, leave the parcel in a safe if you have left an instruction, or return the parcel to local sorting office for collection.
• If an incorrect address is provided for the delivery on your order and the delivery is made to this address, ‘Carlsberg Britvic Group’ reserves the right to refuse a refund if the order has been delivered.
• If an order is returned due to failed delivery attempts, the order amount will be refunded but not the delivery charges.
• If an incorrect address is provided to us and the courier cannot deliver the parcel successfully to you the customer the order will be returned to the sender ‘Carlsberg Britvic Group’ . Once received the order will be refunded to you the customer minus a £9.57 admin fee. This fee will be deducted from the order amount to cover processing, handling and postage costs. If a re-delivery is required, there will be additional shipping fees.

Returns

• Returns must be requested within 14 days of delivery. The customer has an additional 14 days after arranging the request to send the item back. Once the unused items have been received ‘Carlsberg Britvic Group’ will issue a full refund by way of the original payment method minus the shipping fee.
• Return postage costs will be covered by the customer if the customer changes there mind. Items must be returned in a new unused condition.
• All returned items will be inspected upon arrival. If our Quality Control team are unhappy with the condition an item has been returned for example items are missing or have been used resulting in us unable to put the item back into stock, we may not be able to accept your return
• ‘Carlsberg Britvic Group’ aim to refund you within 5 days of receiving the returned item.

Privacy

• Your privacy is critical to us. We respect your privacy and comply with the General Data Protection Regulation with regard to your personal information.
• These Terms and Conditions should be read alongside, and are in addition to our policies, including our privacy policy and cookies policy.

Tax Charges For all orders

20.00% VAT has been added.

Security

All orders are processed on secure servers using the latest encryption techniques.

The shopping cart technology used on this site requires that javascript is enabled in your web browser (Internet Explorer, Firefox etc). Some browser security settings may disable javascript as a security measure – this is not necessary when using this site and will prevent your use of the shopping cart. Security settings are user-adjustable – any changes made are at your discretion and Marstons Brewery cannot accept any responsibility for the consequences of any changes you may make to your browser security settings.

Law & Jurisdiction

These Terms and any matter relating to this Site will be governed by English law and the English courts shall have non-exclusive jurisdiction in respect of them.
