GENERAL TERMS AND CONDITIONS FOR BEER TOWN FILM FESTIVAL COMPETITION 2019

The Promoter

  1. The Promoter is Marston’s PLC (company number 00031461) (trading as “Marston’s Brewery”) with its registered office at Marston’s House, Brewery Road, Wolverhampton WV1 4JT (the “Promoter“).
  2. This promotion is run in conjunction with Burton & South Derbyshire College

 

Entry Requirements

  1. The Beertown Film Festival competition (the “Competition“) is open to UK residents aged from 16 years of age on the closing date of the competition (2nd February 2019). The Competition commences at 3pm on 11th October 2018 and closes at 11.59pm on 2nd February 2019. Entries received after that date and time will not be considered. The Promoters reserve the right in their absolute discretion to extend the closing date for a reasonable period of time where an insufficient number of the entries received have satisfied the entry and judging criteria.
  2. To enter the Competition, you must complete in full the online entry form at https://filmfreeway.com/festival/beer-town-film-festival (the “Website”), answer the questions in that form and submit your entry before the closing date. Your entry can be filmed in a style of your choosing, provided that it complies with the Content Rules (see below), it must not be any longer than the relevant Category maximum time length and must be supplied in the following file formats: avi, mov, wmv, mp4, mpeg, mpg, flv, 3gp, m4v, wm.
  3. Each entrant must be available to attend the Live Final event, which will be held on 8th June 2019 at Marston’s premises in Burton Upon Trent (or such other replacement venue the Promotor may direct). Three finalists from each Category (as defined below) will be invited to attend the Live Final, along with one guest each. The Promoter will reimburse your reasonable travel and accommodation expenses up to a maximum of £150 per finalist (to cover both the finalist and any guest). If the cost of your and your guest’s travel is more than £150 in total then you must pay the difference. You must pay all other costs associated with the prize and not specifically included in the prize, including spending money.
  4. By submitting an entry to us, each entrant warrants and agrees:
    1. that the entry fully complies with these terms and the Content Rules (see below);
    2. that they may be required to take part in promotional activity and shall participate in such activity on the Promoters’ reasonable request. The winner and runners up consent to the use by the Promoters and their related companies, both before and after the closing date of the Competition for an unlimited time, of their voice, image, photograph and name for publicity purposes (in any medium, including still photographs and films, and on the internet, including any websites hosted by the Promoters and their related companies) and in advertising, marketing or promotional material without additional compensation or prior notice and in entering the Competition, all entrants consent to the same; and
    3. that the Promoter may disclose your identity to any third party making any claim or assertion of any kind in relation to your entry.

  6. Entries on behalf of another person will not be accepted and joint submissions are not allowed.
  7. You are responsible for the cost (if any) of creating your Competition entry and sending it to us, as well as all other costs associated with participation in the Competition. Employees or agencies of the Promoter (collectively, “the Promoters”, “We” or “Us”)), or their group companies, or their family members, or anyone else connected with the Competition, may not enter the Competition
  8. Entrants must not use a false name or email or provide any false information when registering for use of the Website / the promotion. Entrants shall not share or disclose their login details or password to any third party. The Promoter may refuse, remove, or suspend registration at any time. Entries must be made by the authorised account holder of the email address submitted.
  9. There is no purchase necessary.
  10. We take no responsibility for entries that are lost, delayed, misdirected or incomplete or cannot be delivered or entered for any technical or other reason. Proof of delivery of the entry is not proof of receipt.
  11. Entrants may only enter the promotion via the Website and entries by email, post or facsimile will not be accepted.
  12. Any entries which have been submitted using scripts, automated systems, collaborative practices or via a third party for commercial gain will be deemed invalid. 
  13. Entrants may use the Website, and enter the promotion, for personal non-commercial use only.

 

The Categories

  1. The categories and category specific rules are as follows:
    • Fiction Short:
      • Entrant age: Above 16 years old on 2nd February 2019;
      • Film details: Short fiction narrative of 20 minutes or less.
    • Documentary Short:
      • Entrant age: Above 16 years old on 2nd February 2019;
      • Film type: factual documentaries of 20 minutes or less (mockumentaries and other fiction not accepted, these need to be submitted in the Fiction Category).
    • Music video
      • Entrant age: Above 16 years old on 2nd February 2019;
      • Film type: The total length of the submission must not exceed 10 minutes in total and must utilise a music track in full for 90% of the duration of the video
    • Short Animation:
      • Entrant age: Above 16 years old on 2nd February 2019;
      • Film type: A minimum of 90% of the film must be animated (in any animated form) and the total length of the submission must not exceed 10 minutes in total.
    • 61 Second Mobile:
      • Entrant age: Above 16 years old on 2nd February 2019;
      • Film Type: Film must be shot entirely on a mobile phone camera, not necessarily edited on a mobile phone. Film must be 61 seconds in length, length can be rounded up or down to one decimal place. Film can be of any genre.
    • Home-Grown:
      • Entrant age: Above 16 years old 2nd February 2019;
      • Film type: films entered in this category must also be entered into one of the other categories as follows: fiction short, documentary short, music video, short animation and 61 Second Mobile (each a “Category”, together the “Categories”);
      • Special requirements: Only open to individuals residing or studying within a 20-mile radius of Burton-Upon-Trent.

 

The Prizes

  1. One main winner will win a cash prize of £1,000.
  2. Five category winners and the People’s Vote winner will each win £500.
  3. The winners will be announced by the Promoter on the night of the Live Final. If a winner rejects their prize, then the winner’s prize will be forfeited and the Promoters shall be entitled to select another winner without liability.
  4. The winners’ prizes will be paid within 28 days.
  5. Please refer to the promotional page on the Website for full details of the prizes on offer.
  6. Prizes are non-transferable, non-refundable and no equivalent is available, except in the Promoter’s absolute discretion.

 

Competition Winners

  1. Main Prize Winner:
  • A panel of judges including representatives of the Promoter and an independent judge, will (based on critical opinion from all complete, eligible and properly submitted entries received) select of shortlist of 15 entries (3 from each Category) by 20 April 2019 (“Finalists”). The Promoters will notify the entrants of the Finalists within one week of that date and request verification of their eligibility to enter the Competition. All Finalists will be posted on the Website.  Any entrants that cannot verify their eligibility to the Promoter reasonable satisfaction, may be disqualified.
  • When choosing all shortlists, Finalists and subsequently the winner, the judges will base their decision on who (in their opinion) demonstrates skill, knowledge and passion. The judges’ decision is final and no correspondence will be entered into.
  • From the Finalists, the overall winner will be decided by the judges and announced at the Live Final. If an entrant is unable to attend the Live Final, the judges may in their discretion select another Finalist from the shortlist without liability to the first Finalist.

 

  1. The People’s Choice Winner:
  • All Finalists will be posted on the Website and beertownfilmfestival.co.uk) by 21st Apr 2011. From that date until 11.59pm on 10 May 2019, members of the public may vote for their favourite entry. Members of the public will only be allowed to vote once. The winner will be the entry that has obtained the most independent votes from member of the public. If two or more entries receive the same number of votes and tie for first, second, third or fourth place, all such entries will become finalists.
  • The winner will receive £500.
  • If a Finalist is unable to attend the Live Final, the judges and the Promotor may, at their discretion select another entrant from the shortlist to become a Finalist, without any liability to the original Finalist.

 

  1. Six Category Winners:
  • From the three Finalists from each Category, a single winner from each Category will be selected by the panel of judges.

  2. All winners will receive their prizes on the date specified or within 28 days of notification of being successful.

 

Facebook / Twitter or other media Platforms 

  1. By participating in the promotion, entrants agree to comply with the Film Freeway https://filmfreeway.com/ platform terms of use from time to time. If there is any inconsistency between these terms and such platform terms, then these terms shall apply.

 

Rules for Competition Entries

  1. All submissions/entries must comply with the following “Content Rules”:
    1. not name or refer to any individual without explicit permission (or include any third party personal information);
    2. not contain the image or likeness of any individual: (1) under the age of 18; or (2) other than the entrant without that individuals’ express consent;
    3. Where an entrant is under the age of 18 on the date of entry, their submissions must not contain any promotional content for products which are aimed at or developed for those over the age of 18.
    4. be your own work and not contain any material that infringes another’s rights, including but not limited to privacy, publicity or intellectual property rights, including copyright infringement;
    5. not disparage or be harmful to the Promoter or any of its brands, employees/directors, customers or pubs;
    6. not in any way mention, refer or otherwise allude to the name, logo or trade mark of any entity, individual, product or brand other than those of the Promoter and its brands; unless explicit permission has been acquired;
    7. not contain material that is inappropriate, contains nudity, is indecent, lewd, pornographic, obscene, illegal, unlawful, hateful, disparaging, defamatory, slanderous or libellous;
    8. not contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, political belief, sexual orientation or age;
    9. not promote excessive or irresponsible drinking or illegal drugs or tobacco (or the use of any of the foregoing); and
    10. not contain any computer virus, bugs, Trojans or other malicious, invasive or harmful code.
  2. If the Promoter has reason to believe that any entry does not comply with these terms, the entry criteria or these Content Rules, we may not consider it and may disqualify it without notice at any time.
  3. All entrants shall own the copyright to all Competition entries as the author. If another person has filmed your entry, (or appears in it) by entering into this competition, each entrants warrants and agrees they have received an assignment of all associated copyright to that entry from that person. The Promoters may ask to see evidence of that assignment at any time.
  4. By submitting an entry to the Competition, you hereby give the Promoters:
    • Permission for your entry to be used for all purposes in connection with  the Competition, including publishing it on the Website and the Additional Websites and grant the Promoters a non-exclusive, royalty-free, worldwide, fully assignable licence to use and publish your Competition entry in electronic format (including on the Promoters’ websites) and hard copy (including in the Promoters’ publications), both as a full video and as screen shots, for purposes connected with the Competition, and the Beertown Festival, and to adapt the entry to enable such publication (including to shorten or edit it for such purposes), and you hereby irrevocably waive, for the benefit of the Promoters, all moral rights in the entry to which you are entitled; and
    • The right to use your name, photograph and town or city of residence for the sole purpose of identifying You as the author of your entry and/or as a finalist or winner of the Competition.

 

Limits on the Promoter’s responsibilities and Indemnities

  1. Winners agree to be fully responsible for any personal or incidental expenses and/or tax liabilities incurred in claiming and using the prizes. The Promoter will not be responsible for any loss or injury resulting from entry into the promotion or a winner’s acceptance and/or use of the prize.
  2. The Promoter will not be responsible for losses, failures or delays relating to circumstances beyond its reasonable control including (but not limited to) acts of God, war, strikes, disputes or the acts or defaults of any supplier of the prizes.
  3. The Promoter will not be responsible for any damage, loss or injury to an entrant that is not reasonably foreseeable. The Promoter’s responsibility for any damage, loss or injury to an entrant under these terms and conditions or otherwise in connection with the promotion shall be limited to the value of the prize won by the entrant.
  4. The Promoter will not be responsible for technical, hardware or software failures, lost, faulty or unavailable network connections or difficulties of any kind that may limit or prohibit entrants’ ability to participate in the promotion. The Promoter does not guarantee that the Website will be operational on any specific device or system or that it will be error free or available all the time.
  5. The Promoter will be liable for any death or personal injury arising from its negligence. Nothing in these terms and conditions will exclude that liability or any other liability, which it is not lawful to exclude.
  6. Each entrant will indemnify (and will keep indemnified) the Promoter and its affiliates against all costs, claims, losses, damages, expenses (including legal expenses) or other liability arising as a result of a breach of these terms and conditions, negligence or any other action which imposes an unreasonable burden on the Website including (but not limited to) the use of software robots.

 

General

  1. By entering, entrants agree to these terms and conditions together with the other polices on the Website, including the Terms of Use.
  2. By entering this Competition, you agree that we may use your personal data to administer you entry and to contact you in connection with the Competition.
  3. The decision of the Promoter is final and no correspondence will be entered into.
  4. The Promoters may pass entrants’ details to third parties and/or otherwise engage third party providers in connection with this Competition where the third party is acting on the Promoters’ behalf for the purposes of administering this Competition and/or any subsequent publicity, and/or for the purposes of sending you the Promoters’ marketing materials; and/or as otherwise required by law.
  5. The Promoter reserves the right to eliminate or disqualify any entries or entrants who the Promoter has reasonable grounds for believing are in breach of these conditions.
  6. The Promoters reserve the right at any time and from time to time to modify or discontinue, temporarily or permanently, this Competition with or without prior notice due to reasons outside their control (including, without limitation, in the case of anticipated, suspected or actual fraud). The decision of the Promoters in all matters under its control is final and binding. The Promoters reserve the right to discount votes if they suspect fraudulent bulk voting or multiple voting is or has taken place to inappropriately influence or manipulate the voting procedures.
  7. The Website may contain links to other websites, including those belonging to the Promoter’s partners. These links are provided for convenience and are not under the control of the Promoter and as such we make no warranty, either expressed or implied, concerning the content of such sites including claims of infringement or that such sites are devoid of viruses or error free.
  8. The rights and remedies of the Promoter under these terms and conditions are without prejudice to its rights under the law.
  9. These terms and conditions shall not create any rights or benefits enforceable by any third party by virtue of the Contracts (Rights of Third Parties) Act 1999.
  10. These terms and conditions are made under English law. Any dispute or claim that an entrant or the Promoter brings in relation to or in connection with these terms and conditions or the promotion will be decided on the basis of English law by the English courts alone.
  11. It is not the intention of this promotion in any way to encourage people to consume excessive amounts of alcohol. The Promoter encourages responsible drinking.
